Re:cycle Program - Terms and conditions

In these terms and conditions, the expressions "Michael Hill", "we", "us" and "our" are a reference to Michael Hill Jeweller (Australia) Pty Ltd.

Definitions

• Re:Cycle Program means the gold jewellery recycling program offered by Michael Hill from time to time.
• Gold Recycling Package means the postal package issued to you by Michael Hill for the purposes of sending your item/s for assessment under the Re:Cycle Program.

Terms and Conditions

These terms and conditions apply to the transaction/s contemplated by using this website and as part of the Re:cycle Program.

1. The Re:cycle Program is available to Australian residents only who are aged 17 years.
2. By requesting a Gold Recycling Package from us, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you must refrain from requesting a Gold Recycling Package and from sending us an Invitation.
3. These terms and conditions must be read in conjunction with any other applicable terms and conditions governing the use of the Re:cycle Program website, including but not limited to the Michael Hill Privacy Policy.
4. Michael Hill accepts only:
   1. jewellery items made from a minimum of 9k yellow, rose and white gold alloys;
   2. stones of any type which form part of a jewellery item described in section 4(a);
   3. other precious metal items at Michael Hill’s discretion,

that Michael Hill elects to accept from time to time, together the ("Acceptable Items").

5. By requesting a Gold Recycling Package via any communication channel (whether by this website, an email request or online chat function, or at a one of our stores), or by submitting any information on this Re:cycle Program website or on any third party plug-in used by this website, you warrant and agree that:
   1. the personal information details you provide to us are your personal details and not the personal details of any other person;
   2. all information (including but not limited to personal information) you provide us is accurate and complete;
   3. you are the sole legal and equitable owner of the item/s you send to us as part of the Re:cycle Program;
   4. all item/s you send to us are an Acceptable Item;
   5. any image that you upload of jewellery item/s onto the Re:cycle Program website is a true and accurate image of the jewellery item/s that you place into the Gold Recycling Package and send to us; and
   6. by sending item/s to Michael Hill in accordance with the instructions provided on this website, you invite Michael Hill to offer to purchase those item/s from you ("Invitation").
6. You acknowledge that Michael Hill must verify your identification in accordance with its legal obligations and you will comply with section 5 above when providing your information as part of that verification process.
7. When Michael Hill receives your item/s, your items will be inspected and assessed by Michael Hill’s quality assurance team.
8. If your item/s are deemed to be Acceptable Items following the inspection and assessment described in section 7, Michael Hill will offer to purchase your item/s for a value accordance with the quoting methodology described in the FAQs ("Offer”). The consideration proposed in the Offer will be by Michael Hill gift card for use in any Michael Hill store online specified in Australian dollars.
9. Michael Hill may in its discretion decline to accept your Invitation in relation to any one or all of the item/s you send, including because an item is not an Acceptable Item or the transaction is deemed a high risk transaction in accordance with Michael Hill’s risk management policies. Michael Hill’s decision to decline your Invitation, whether in part or full, is final and is not obliged to notify you of any reason why.
10. If you accept the Offer:
    1. all legal and equitable ownership in the whole item/s immediately transfers to Michael Hill at the time you accept the Offer;
    2. you and all other owners of the whole item/s (if any) have no further claim to the item/s; and
    3.  you acknowledge that you have read and understood Michael Hill's gift card terms and conditions and accept with those terms and conditions.
11. If you do not accept the Offer, or if Michael Hill declines to accept your Invitation, Michael Hill will return your item/s free of charge to you.
12. The Gold Recycling Package, and any return package sent by Michael Hill to you, will be a third party product with a reputable postal carrier or courier nominated by Michael Hill ("Postal Service"), and is subject to that third party's terms and conditions.
13. In the event your Gold Recycling Package (or the return envelope from Michael Hill to you if you do not accept the Offer) is:
    1. registered received by the Postal Service;
    2. not delivered to the intended recipient, being Michael Hill or you (as applicable) within 21 days of receipt by the Postal Service; and
    3. deemed 'lost' by the Postal Service,

your item/s will be considered "Lost in Transit" by Michael Hill.

14. Where your item/s are Lost in Transit on its way from Michael Hill to you, the value of your item/s will be the value of the Offer made to you.
15. Where your item/s are Lost in Transit on its way from you to Michael Hill, Michael Hill will review the information and images you provided as part of your Recycling Gold Program request, and determine a reasonable value of the lost item/s. This reasonable value will take into consideration the pre-quote amount displayed on our website as part of your request. Michael Hill's determination of the value is final.
16. The value described in sections 14 and 15 will be considered "Compensation Value” by Michael Hill. Michael Hill will provide you with a Michael Hill gift card for an amount equivalent to the Compensation Value up to a maximum of $5,000. You acknowledge that you have read and understood Michael Hill's gift card terms and conditions and accept with those terms and conditions.
17. By participating in the Gold Recycling Program, you agree:
    1. and accept that the method of calculating loss and Compensation Value specified in sections 14 and 15 is reasonable; and
    2. that the maximum liability of Michael Hill for your Lost in Transit items is the lesser of the Compensation Value or $5,000 paid by way of Michael Hill gift card.
18. Michael Hill does not accept liability for any consequential or indirect loss arising due to items Lost in Transit.
19. Michael Hill will collect, hold use and disclose your personal information for identity verification purposes and other purposes described in the Michael Hill Privacy Policy personal in order to process your item/s under the Gold Recycling Program. You acknowledge that we may need to contact you for further verification of your identity or to confirm or discuss any details about your item/s under the Gold Recycling Program in accordance with the Michael Hill Privacy Policy.
